LOAN TRANSACTIONS / REAL ESTATE FINANCING

Horack Talley’s attorneys have substantial experience in real estate financing including providing advice on the financing structure; drafting, reviewing and negotiating loan documents and the closing, restructuring and workout of acquisition, construction, and permanent loans.  Our regular representation of both borrowers and lenders in real property financing transactions enables our attorneys to consider the transaction from multiple perspectives to better negotiate terms favorable to our client’s wishes while meeting the other party’s underlying concerns.          

With real estate attorneys licensed in both North Carolina and South Carolina we are able to advise clients and conduct closings for clients with property located in both states.  We frequently serve as local counsel to developers involved in multi-state deals to advise on matters of local law and provide the North Carolina and/or South Carolina law opinion their lenders require. We also assist clients in managing due diligence requirements from lenders including providing the various certifications, opinions and other documents lenders require in connection with a closing.
